Update
Colorado Contractors Association is expanding our
partnerships with Move Colorado and Capitol Solutions to now include
Pure Brand Communications.
As
members, many of you are aware of the crucial necessity for the
advocacy program which was created to assist CCA in
promoting a steady stream of funding for Colorado's infrastructure
system. This expanded advocacy effort is funded in part by
the CCA special assessment.

Colorado's transportation system is on life support. Consider the following
findings from TRIP, a national transportation nonprofit research
group:
- Nearly one-third of Colorado's major roads and highways have pavements in poor or mediocre
condition.
- Colorado has 122 (and counting) structurally deficient bridges throughout
the state.
- Seventeen percent of bridges
in Colorado show significant deterioration or do not meet current design
standards.
These
are roads and bridges that we rely on everyday to get our children
safely to school, transport goods to market and ensure we're to work
on time. And, they are roads and bridges that are deteriorating
beneath us. Chances are, regardless of where you live or conduct
business throughout the state, you are driving on one of these
deteriorating bridges or roads almost every day. Click

PPP Transit Projects Workshop Coming to Denver
CCA members interested in learning more about the use of Public
Private Partnerships (PPP’s) for transit projects are encouraged to register for the CCA

The event kicks off with a June 11 networking reception and
continues with a one day seminar on June 12 to discuss the use of
PPP
’s on transit projects. Since
this is the direction FasTracks is headed, this seminar comes at an
ideal time for our community.

A Skilled Worker Shortage is Expected to
Impact the Construction Industry & CCA Can Help You!
CCA is working with the Adams County Workforce and
Business Center to make it easy for CCA members to hire new
employees. We are providing a clearing house for individuals
wishing to find a career in the construction industry. The Adams
County Workforce and Business Center will find and evaluate potential
employees and assist CCA Members with interviews and the hiring
process. The CCA Member, no matter where their office or project
is located, only has to make one phone call to the Adams County
Workforce and Business Center who will handle their job order and
refer a group of candidates to your company to be interviewed and
hired. If your company is working outside the metro area the
Adams County Workforce & Business Center will coordinate your
workforce needs with the Workforce Center nearest to your company’s
project or provide you with Adams County residents who are willing to
travel and work on the project. It’s easy to get started -

CCA Member and that you would like to post a Job Order.

The

having 27 holes means everyone plays the tournament at the

Appeals Court
Clarifies ‘No Damage For Delay’ Clauses
Longtime CCA member Tricon Kent Company has successfully
pursued an appeal in the Colorado Court of Appeals that at last gives
Colorado some clarity on the important construction law issue of no
damages for delay clauses. Tricon was represented by Berg, Hill,
Greenleaf and Ruscitti. Lead counsel Dan Gross (also a longtime
CCA member) informs us that Colorado now expressly acknowledges that
no damages clauses are enforceable, but that Colorado also recognizes
one the key exceptions to their enforcement--"active
interference."
The Tricon case concerns a no damages for delay
clause in a subcontract between two private companies. (Since 1989
Colorado has had a statute that precludes a public owner from
enforcing a no damages clause in a public works contract.) A no
damages for delay clause in a subcontract limits a delayed
subcontractor to an extension of time and prevents recovery of the
cost of delay. Colorado has joined the numerous States around the
country that recognize that if the prime "actively
interferes" with the sub and thus causes the delay, the clause
may not be invoked to preclude recovery of delay costs.
The Tricon case is of particular interest to CCA members because it
involved a CDOT project. One of Tricon's contentions, which the
Court of Appeals agreed with, was that the prime's decision not to
follow the CDOT phasing plan in the prime contract was part of the
active interference.

CDOT has begun its comment period for additions and changes to CDOT
Specs. All CCA members
doing business with CDOT or other entities that rely upon CDOT
Specifications are asked to review CDOT’s proposed changes and to
submit comments to CCA.
All CCA members are also invited to attend an
upcoming meeting to comment on proposed changes and to discuss
potential changes under consideration.

FINAL REMINDER - Constructability Review – Region 4 Modified Design
Build Project – Bridges over Big Thompson
CCA and CDOT Region 4 will be hosting a Constructability Review for an
upcoming Modified Design Build Project that will include two bridges
over the Big Thompson River near Estes Park.A very rough estimate of
the cost for design and construction of this project is $3 million.
The Review will be on Wednesday, June 4 at 9am
at the CDOT Loveland Residency Office located at 2207 E. Highway 402,

State University Construction Management Department Endowed Chair
Donors Honored
FORT COLLINS - Industry members recently gathered on Colorado State University's
campus to recognize lead contributors to the Heavy Construction
Management Endowed Chair, a permanent faculty position in the
Department of Construction Management.
The
first phase of the two-phase plan is to pass the $1.5 million mark,
with the longer-term goal of reaching a $3 million endowment next on
the horizon.
A
reception highlighted two of the lead donors: Colorado Contractors
Association of Denver and Connell Resources of Fort Collins. Both

by the wind. Slag falls on surfaces or materials below. And a welding

FHWA
Reports A Historic Drop In Driving – Highway Trust Fund Revenue
Impacted
The Federal Highway Administration (FHWA) reports that
Americans drove less in March 2008 than a year ago and that this
continues a downward trend in travel that began in November 2007.
FHWA's "Traffic
Volume Trends" report, produced monthly since
1942, shows that estimated vehicle-miles traveled (VMT) on all U.S.
public roads for March 2008 fell 4.3% as compared with March 2007
travel. This is the first time estimated March travel on public roads
fell since 1979. March 2008 travel was 11 billion miles less than in
the previous March, this is the sharpest yearly drop for any month in
FHWA history. Cumulative VMT has fallen by 17.3 billion miles since
November 2006. VMT fluctuated between November 2006 and November 2007
but since November 2007 the trend has been steadily downward. Total
VMT in the U.S. for 2006, the most recent year for which such data are
available, topped 3 trillion miles. Click

U.S.
Carbon Dioxide Emissions Grew in 2007, Agency Says
Carbon dioxide emissions in the U.S. were up about 1.6% last
year, according to the Energy Information Administration, reversing a
1% decline in 2006. Power generation, the main source of carbon
dioxide emissions, increased 2.5% for the year. Despite the absolute
increase in carbon dioxide, however, emissions fell about .5% when
